1. Agreement to Terms

By accessing or using Pinquisite ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms apply to all users, including visitors, registered users, and premium subscribers.

2. Description of Service

Pinquisite is a geography-based quiz game where users test their knowledge by identifying locations on an interactive globe. The Service includes:

• Solo gameplay with various question types
• Duel mode for competitive play against other users
• ELO-based rating system with tiers (Bronze, Silver, Gold, Platinum, Diamond, Master)
• Badge and achievement system
• Daily challenges
• Global and friend leaderboards
• Group/Party mode for multiplayer sessions

We work diligently to identify and correct any inaccuracies as soon as they are discovered. If you encounter a question you believe contains incorrect information:

• We appreciate your understanding that errors may occur
• Please report any suspected errors through our feedback system
• We review all reported issues and make corrections promptly
• Scores affected by verified errors may be adjusted at our discretion

The Service is provided for entertainment and educational purposes. While we aim for accuracy, Pinquisite should not be used as a definitive source for geographic or academic research.

4. User Accounts

To access certain features, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use
• Not share your account with others

You must be at least 13 years old to create an account. Users between 13 and 18 must have parental or guardian consent.

To ensure a fair and enjoyable experience for all players, you agree not to:

• Use cheats, bots, scripts, or automation tools
• Exploit bugs or glitches for unfair advantage
• Manipulate your ELO rating through collusion or match-fixing
• Create multiple accounts to circumvent restrictions
• Use external tools to look up answers during timed matches
• Harass, threaten, or abuse other players
• Share inappropriate or offensive content
• Attempt to access other users' accounts
• Reverse engineer or interfere with the Service

Violations may result in warnings, temporary suspensions, permanent bans, or ELO rating resets at our sole discretion.

7. ELO Rating and Rankings

The ELO rating system is designed to match players of similar skill levels. Key points:

• All players start with a base rating of 1200 (Silver tier)
• Ratings change based on match outcomes and opponent ratings
• Tiers are determined by rating thresholds
• We reserve the right to adjust ratings to correct for bugs or cheating
• Leaderboard rankings are updated in real-time

ELO ratings and badges have no monetary value and cannot be exchanged or transferred.

8. Intellectual Property

All content in the Service, including but not limited to graphics, logos, questions, user interface, and software, is the property of Pinquisite or its licensors and is protected by intellectual property laws. You may not:

• Copy, modify, or distribute our content without permission
• Use our trademarks without written consent
• Scrape or harvest question data from the Service

Map data is provided by third-party services and is subject to their respective terms.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The Service will be uninterrupted or error-free
• All questions and geographic data will be perfectly accurate
• The Service will meet your specific requirements
• Results obtained from the Service will be accurate or reliable

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PINTERRA QUIZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.

11. Account Termination

You may delete your account at any time through the account settings. We may suspend or terminate your account if:

• You violate these Terms
• You engage in prohibited conduct
• Your account shows signs of fraudulent activity
• Required by law

Upon termination, your right to use the Service ceases immediately. We may retain anonymized game data for analytics purposes.

Any disputes arising from these Terms or your use of the Service will be resolved through:

• Good faith negotiation between the parties
• If negotiation fails, binding arbitration in accordance with applicable rules

You agree to waive any right to participate in class action lawsuits against us.

We reserve the right to modify these Terms at any time. Material changes will be communicated through the Service or via email. Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.

14. User-Generated Content

Users may create content including usernames, profile information, and avatar images. By submitting content, you:

• Grant us a non-exclusive, royalty-free license to display your username and profile on leaderboards and in multiplayer matches
• Warrant that your content does not infringe any third-party rights
• Agree not to use offensive, discriminatory, or inappropriate usernames
• Acknowledge we may remove or modify content that violates these Terms

We reserve the right to reject or require changes to usernames at our sole discretion.

15. Third-Party Services

The Service integrates with third-party services including:

• Map providers: We use third-party map services to display geographic data. Your use is subject to their terms.
• Payment processing: Premium subscriptions are processed by Stripe. Your payment information is handled directly by Stripe under their privacy policy and PCI-DSS standards. We do not store your full payment card details.
• Authentication providers: If you sign in using third-party services (e.g., Google, Apple), their terms and privacy policies apply to that authentication.
• Analytics: We use analytics services to improve the game experience.

We are not responsible for the practices of third-party services. We encourage you to review their policies.

16. Service Availability and Modifications

We strive to maintain the Service but do not guarantee uninterrupted availability. We reserve the right to:

• Modify, suspend, or discontinue any part of the Service with or without notice
• Perform maintenance that may temporarily affect availability
• Update game features, questions, scoring systems, or tier thresholds
• Reset or modify seasonal leaderboards and rankings
• Add, modify, or remove badges and achievements

We will provide reasonable notice for significant changes affecting Premium subscribers where feasible.

17. Indemnification

You agree to indemnify, defend, and hold harmless Pinquisite, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Any content you submit or share through the Service

18. International Users

The Service is operated from the United States. If you access the Service from outside the United States, you do so at your own risk and are responsible for compliance with local laws. By using the Service, you consent to the transfer of your information to the United States and other countries which may have different data protection rules.

19. Communications

By creating an account, you consent to receive electronic communications from us, including:

• Service communications: Account verification, password resets, security alerts, and important updates (required)
• Game notifications: Duel invitations, friend requests, and achievement unlocks (can be managed in settings)
• Marketing communications: News, promotions, and feature announcements (optional, with easy unsubscribe)

You may opt out of marketing communications at any time via your account settings or the unsubscribe link in emails. You cannot opt out of essential service communications.

20. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, riots, government actions, power failures, internet or telecommunications failures, or cyberattacks.

21. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware.

Notwithstanding the foregoing, we may seek injunctive or other equitable relief in any court of competent jurisdiction to protect our intellectual property rights.

22. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving its original intent.

23. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on the Service, constitute the entire agreement between you and Pinquisite regarding your use of the Service. These Terms supersede any prior agreements or understandings, whether written or oral.
